The Supreme Court has created an unlikely avenue for Democrats to troll the GOP, according to two experts.
The Supreme Court recently ruled that The National Trust for Historic Preservation lacked standing to challenge the construction of President Donald Trump’s ballroom, a more-than-$400 million structure that will include a bomb shelter and an anti-drone defense system. Attorney Brian Kabateck noted on a new episode of his podcast, “Civil Action,” with co-host Shant Karnikian, that the court’s reasoning creates a loophole future Democratic administrations could use to renovate the White House without Congress’ consent.
Kabateck described the ruling as “pure sophistry” because the court acknowledged that Trump’s ballroom project is likely illegal but argued that the National Trust for Historic Preservation lacked standing to challenge it.
While Trump celebrated the ruling, Kabateck noted that it creates a couple of scenarios in which a future Democratic president or Congress could use it against Trump and the Republican Party.
In one scenario, Kabateck argued that Congress could pass a law that prohibits Trump from completing the ballroom. Even though that seems unlikely because of Congressional gridlock, the Supreme Court also laid out this possibility in its ruling, Kabateck noted.
At the same time, Democrats could use the ruling to do something “outrageous” like build a hypothetical Dolly Parton Center for LGBTQ Rights, something that Trump’s MAGA fans “would go nuts over,” Kabateck said.
