Senate Democrats blocked a Republican-led data center bill Wednesday, dismissing it as empty political theater designed to help vulnerable Sen. Jon Husted (R-OH) survive his first full term in office.
According to NBC News, the measure, known as the Ratepayer Protection Act, couldn’t clear the 60-vote threshold needed to overcome a Democratic filibuster, despite having sailed through the House earlier this month with near-unanimous bipartisan backing. The bill would have set a new federal standard directing state utility regulators to weigh whether large data centers, those pulling at least 100 megawatts of power, should bear the full cost of the grid upgrades their operations require.
Democrats argued the bill’s language was too weak to actually force anyone to do anything. Senate Minority Leader Chuck Schumer (D-NY) mocked it on the floor as a hollow gesture. “I can sum up the shortcomings of the Republican data center bill with one word: optional,” Schumer said.
Husted, who was appointed to the seat and is now fighting to keep it against Democratic challenger and former Sen. Sherrod Brown, pushed back hard against accusations that Democrats actually care about lowering electricity costs. “I heard they said they wanted lower electricity prices,” Husted said.
Schumer offered the opposing view, dismissing the bill itself as empty. “While Americans are demanding real guardrails on AI and data centers, Republicans are offering a toothless messaging bill. We need real action on data centers,” Schumer said.
Senate Majority Leader John Thune (R-SD) dismissed Democratic claims that Republicans were simply trying to hand Husted a political win ahead of November, while retiring Sen. Thom Tillis (R-NC) credited Husted for putting the cost issue on the national radar regardless of the bill’s fate.
The politics cut close to home for Husted specifically. Brown has spent much of the campaign branding his opponent “the face of data centers” over Husted’s past efforts, as Ohio’s lieutenant governor, to attract the facilities to the state through generous tax incentives, an attack line Republican strategists reportedly view internally as a real liability heading into November.
Democrats say they’d rather pass their own competing measure, the GRID Savings Act, which would make data center operators pay mandatory costs to connect to the power grid rather than leaving the decision up to individual states. Polling cited in the debate found voters trust Democrats over Republicans on data center policy by a 12-point margin, even as the failed vote leaves the underlying cost question unresolved for consumers on both sides of the aisle.
Data center construction, which has been turbocharged by the pace of AI development, has become a massive hot-button issue, as locals fear these facilities will be a drain on electricity and local resources, as well as generate noise pollution. For some, the issue has also become a proxy fight over general distrust of new AI and fear for its societal consequences. President Donald Trump has dismissed all objections, demanding communities accept data centers as tools of local wealth creation.
