UPDATE (6:15 p.m.): A driver accused of dragging a man two miles to his death said he didn’t know the victim was under his SUV.

The defense attorney said he believes this is the case because the two men did not know each other before the fight that led to all of this.

30-year-old Jacob Cross entered the courtroom for his arraignment Thursday morning in tears. In court, Cross pleaded not guilty to a murder charge in the death of 57-year-old Sam Walker.

“I don’t think there was any intent to cause harm to the guy, but we’ll have to see,” Defense Attorney Jeff Deen said.

The two got into a fight at the Circle K at Schillinger and Three Notch in Tillman’s Corner last Wednesday. Deen said Cross kept trying to leave during the fight, but Walker jumped in the SUV.

“They had been fighting,” Deen said. “Over him trying to talk to a woman that he had a romantic interest in. And this stranger coming in and butting in.”

Police said Cross got into his SUV and intentionally hit Walker several times, then dragged him for two miles. Cross called 911 after driving to his home on Dawes Lane and seeing Walker’s body.

News 5 asked the defense if Cross had no idea this man was underneath the vehicle, and he confirmed.

Cross remains in Metro Jail on a $500,000 bond on the murder charge. He is due back in court for a preliminary hearing on Nov. 13.

PREVIOUS REPORTING:

MOBILE, Ala. (WKRG) — A man accused of dragging a man two miles to his death says he didn’t know the victim was under his SUV.

Jacob Cross, 30, was crying as he entered the courtroom today for his arraignment in downtown Mobile.

He pleaded not guilty to a murder charge in the death of 57-year-old Sam Walker.

The two got into a fight at the Circle K at Schillinger and Three Notch in Tillman’s Corner last Wednesday.

INCIDENT LOCATION:

During Cross’s bond hearing on Friday, a homicide detective testified that Cross got into an argument with his ex-girlfriend, an employee at the Circle K gas station.

The detective said that’s when Walker asked the woman if she was okay, and the two men got into a fight.

Mobile County District Attorney Keith Blackwood said Walker was trying to do the right thing, but the situation became violent.

“The evidence that I’ve seen and that we have shows that Jacob Cross intentionally ran over this good Samaritan, causing his death with the vehicle,” Blackwood said last week.

Police have said Cross got into his SUV and intentionally hit Walker several times, then dragged him for two miles.

Cross said today that he didn’t know that Walker was under his SUV, and he called 911 after driving home to Dawes Lane and seeing his body.

“We’ll find out more as it develops,” Jeff Deen, the defense attorney, said. “But I don’t think any intent to cause harm to the guy…”

Cross remains in Metro Jail on a $500,000 bond on the murder charge.

He’s due back in court for a preliminary hearing on Nov. 13.
