HUNTSVILLE, Ala. (WHNT) — The driver of the dump truck that crashed into the South Huntsville Target at the end of July is facing multiple traffic charges, court records show.

The Huntsville Police Department said the crash happened just after 1:30 p.m. on July 30 at the Target on Carl T. Jones Drive when a dump truck was traveling down Ledges Drive and reportedly experienced a brake failure. Police said the truck then continued until it hit the South Huntsville Target store, injuring the passenger and trapping the driver.

A crash report obtained by News 19 lists the driver of the truck as Nicholas Randall Baker of Jefferson City, Tennessee. He is facing a number of traffic violations, including driving while his license was revoked and operating a commercial vehicle without a required commercial driver’s license.

The charges were filed on August 4, five days after the crash. The charges say the vehicle was operated unlawfully.

News 19 is working to get more information, but Baker’s employer is listed as Harper Tree Service. The accident lists two people injured in the crash, Baker and truck passenger Jason Lee King. Officials originally said at the time of the crash that King’s injuries were non-life-threatening.

The charges also include Baker not possessing a commercial driver’s license medical certificate. That is a required federal certification related to the driver’s physical and medical fitness to operate a commercial vehicle.

HPD said the driver of that other vehicle that was hit by the truck wasn’t injured, but the car was significantly damaged.

Emergency teams with the Huntsville Fire and Rescue and Madison County Rescue Squad worked for a couple of hours to get the driver out of the dump truck, eventually able to pull him out of the truck.

While crews were attempting to tow the truck out of the building, News 19 crews on scene saw an awning that was sitting on top of the truck collapse. There was also a large hole visible in the brick wall outside.

Court records show Baker has a court appearance on September 1.
