Information from Prince Harry’s immigration records will be made public with some redactions, the Department of Homeland Security notified a federal judge Thursday.
Washington, DC, federal Judge Carl Nichols earlier this month ordered the feds to come up with redacted versions of the Duke of Sussex’s immigration file for his review in hopes of making the records public.
The DHS Thursday said it agreed to release three parts of the royal’s records, according to the document filed in DC federal court as part of an ongoing battle by the conservative Heritage Foundation to reveal whether Harry divulged he’d used drugs when he applied for a visa.
The filing cryptically said DHS agreed to turn over “items 1-3” of the royal’s records, subject to redactions, but said they wouldn’t agree to release “item 4.”
The document didn’t elaborate further on what information the items contained. But at a hearing earlier this month, Nichols indicated that the royal’s visa application itself wouldn’t be released in the current batch of records at issue.
“I’m going to take this in stages,” Nichols said at the Feb. 5 hearing, indicating he wanted to ensure no disclosures violated US privacy laws shielding the Duke. Instead, the judge said he was considering releasing statements made by DHS officials who reviewed Harry’s records.
DHS has until March 6 to come up with the redacted version of the records to submit for the judge’s approval.
The Heritage Foundation filed suit in 2023 for Harry’s visa records after he wrote in his memoir “Spare” that he’d used cocaine, cannabis and psychedelic mushrooms.
The think tank wanted to know whether the Duke disclosed the information on the part of the application asking about prior drug use and whether he was given a waiver to live in the US in spite of the disclosure.
