Pages of unsealed evidence against Donald Trump in his federal election subversion case are “crucially important” for voters ahead of Election Day in November, according to the former president’s estranged niece Mary Trump.
U.S. District Judge Tanya Chutkan released a 165-page document filed by special counsel Jack Smith on Wednesday that outlines the Justice Department’s accusations that Trump attempted to remain in the White House even after knowing that he lost to President Joe Biden in 2020.
Prosecutors in the document focus on Trump’s actions as a private citizen and candidate, not as the president, in response to the Supreme Court‘s ruling in July that determined Trump is protected from facing criminal charges related to his “official acts” performed as president.
Trump faces four federal felony counts in this case, including conspiracy to defraud the United States. The new evidence in Smith’s document includes accounts of Trump and his operatives insistently pushing claims that the 2020 election was marred by voter fraud—despite GOP-aligned officials telling the former president that such claims were false.
In a post to her Substack blog on Thursday, Mary Trump, a psychologist who is frequently critical of her uncle, highlighted several parts of Smith’s filing, including detailed accounts of Trump’s operatives who “sought to create chaos, rather than seek clarity” at state polling stations under scrutiny for voter fraud. She also homed in on Smith’s evidence related to the former president’s actions on January 6, 2021, when Trump’s supporters stormed the U.S. Capitol while Congress was certifying Biden’s victory.
“Because Donald Trump has been so effectively able to game the legal system in his favor, there is no way that this case is going to trial before the election,” Mary Trump wrote, referring to the former president’s plethora of other legal challenges that have been delayed in court until after the 2024 election. “Because of the corrupt illegitimate super majority of the Supreme Court, there’s a real possibility this case will never go to trial at all.”
“It was, therefore, crucially important that Judge Chutkan and Jack Smith got this information in front of the electorate before November 5,” she added. “We deserve to know all of the damning details about the depths of Donald Trump’s depravity. We need to know that the presidential candidate the Republican Party nominated, and the traitor they continue to support almost unequivocally, engaged in a conspiracy against the American people.”
Newsweek reached out to Trump’s office via email for comment Thursday.
Trump has pleaded not guilty to all charges included in Smith’s indictment and adamantly maintains his innocence. He also accuses prosecutors of attempting to interfere with his chances of a second term in the White House.
The former president’s defense team had sought to conceal large parts of Smith’s document, which was already heavily redacted, arguing that the Justice Department was seeking to release a “politically motivated manifesto” shortly before the election.
Chutkan, however, dismissed the argument, writing in a court filing on Wednesday that such “accusations, for which Defendant provides no support, continue a pattern of defense filings focusing on political rhetoric rather than addressing the legal issues at hand.”
Trump on Wednesday raged over Truth Social that the “release of this falsehood-ridden, Unconstitutional, [January 6] brief” was “another obvious attempt by the Harris-Biden regime to undermine and Weaponize American Democracy, and INTERFERE IN THE 2024 PRESIDENTIAL ELECTION.”
“Deranged Jack Smith, the hand picked Prosecutor of the Harris-Biden DOJ, and Washington, D.C. based Radical Left Democrats, are HELL BENT on continuing to Weaponize the Justice Department in an attempt to cling to power,” the former president added.
