Trump demands the Supreme Court rehear birthright citizenship case

President Donald Trump is demanding the Supreme Court rehear and reverse its 6-3 decision upholding birthright citizenship under the 14th Amendment in Trump v. Barbara.

Georgetown law professor Steve Vladeck notes the Court hasn’t reheard a case since 1965 and has reversed itself only once after a rehearing in 1957.

During June’s ruling in favor of birthright citizenship for children of immigrants here illegally or on temporary visas, Chief Justice John Roberts wrote, “Citizenship, then and now, was the right to have rights — to freely participate in our political community.”

Trump took to Truth Social to protest the court’s decision, “Signs and Billboards are being put up all over our Southern Border, and Mexico, advertising BIRTHRIGHT CITIZENSHIP, with ‘Deliveries starting at $4000.”

“AMERICAN CITIZENSHIP IS NOT FOR SALE! In fact, that is a crime, and therefore, the Supreme Court’s ruling is wrong,” he added, “I will be asking for a Rehearing by the United States Supreme Court, IMMEDIATELY. This miscarriage of justice will destroy America if they don’t change their absolutely insane decision.”

Vladeck called Trump’s request “a virtual dead-letter.”

For a rehearing, one of the six justices who voted against Trump would need to request it. Trump has until July 25 to file formally.
