Meta Is Using Its Massive AI Data Centers to Avoid Paying Billions of Dollars in Taxes

The AI industry’s data centers aren’t belching pollution, driving their neighbors bonkers with screeching noise, and using up vast amounts of power and water. They’re also allowing companies to exploit tax breaks to save billions of dollars on their federal tax bill.

As the New York Times reports, Meta is writing off its enormous, multibillion-dollar data center construction projects as “pilot models,” a Reagan-era tax credit originally intended to support companies dabbling in potentially risky research and experimentation.

Put differently, the Mark Zuckerberg-led company is telling the IRS that its data center buildouts are far from guaranteed to pay off in order to claim billions of dollars in tax credits.

The news comes amid a major public backlash to the facilities, a bipartisan movement that has grown so much, it could prove influential in the upcoming midterm elections. Knowing that the companies’ plans are being used to avoid taxes is likely to infuriate an already extremely wary public.

It’s also a ruse that Meta’s own accountants admit amounts to an incredibly dubious interpretation of the “pilot models” tax break. According to recent securities filings reviewed by the NYT, the company said that it may have to pay the IRS back the money it saved due to “uncertainties with our research tax credits.”

There’s precedent. Thousands of companies have already been called out by the IRS for abusing the credit for regular expenses, per the newspaper’s reporting.

Meta has been exploiting the loophole for two years now. In 2024, the company saved $2 billion. In its 2025 fiscal year filing, it saved almost $4 billion, making it the largest known beneficiary of the credit to date among public companies.

The IRS is still trying to claw back $355 million Meta saved after exploiting another tax break loophole in 2013 for the development of its News Feed.

Company spokesperson Andy Stone assured the NYT that Meta was spending copious amounts of money on research and development to support “American jobs.”

But whether the IRS will buy the company’s excuses to wriggle out of billions of dollars of taxes remains to be seen.

The exploit is part of a much broader and troubling trend. The AI industry has already garnered a reputation for posting inflated “vibe revenue” and “creative accounting,” while operating in a regulatory vacuum, adding to concerns over a possible AI bubble, which experts fear is on the verge of popping.

In short, Meta is trying to fudge the numbers to save itself from having to pay taxes — which could throw even more fuel on the fiery debate surrounding the AI industry’s attempts to justify its enormous data center buildouts.
