A repeat transit offender allegedly bit a police sergeant last week while violently resisting arrest — and was promptly sprung by a judge anyway, The Post has learned.
Derrick Daniels, of New Jersey, already on the NYPD’s radar, was at the Brighton Beach subway station in Brooklyn when cops spotted him around 5:15 a.m. on Sept. 13, cops said.
Aware of a bench warrant for his arrest, two police officers pursued Daniels, 23, according to an NYPD spokesman.
“They tried to take him into custody [and] he violently resisted arrest,” the spokesman said.
That’s when he allegedly bit the sergeant in the forearm, breaking her skin and leaving her bloody, a photo of the injury shows. She’s recuperating at home, cops said. A detective also suffered injuries to his knee, police said.
Police slapped Daniels with two counts of assault. He was also hit with two counts of grand larceny for alleged thefts at the Parkside Avenue station on Aug. 26 and at the Stillwell Avenue Station on Sept. 9, cops said.
In both cases, Daniels took phones from people who were sleeping, and had the phones on him when he was arrested, police said.
Daniels has seven prior arrests, three of them in the past year, for crime in transit, police sources said.
More than half the people arrested in 2026 so far for transit crimes had three or more arrests, according to police.
“When we talk about transit, this guy is one of the select few,” a police source said. “Our cops are laser focused on them.”
Despite the bloody cop and Daniels’ long rap sheet, Judge Michele Russo released him on non-monetary conditions, court records show. It wasn’t immediately clear if prosecutors asked for bail, as an email to the Brooklyn district attorney’s office wasn’t returned.
The revolving door criminal justice system is a problem in the city’s transit system, a police source said.
“Clearly, the rest of the system needs to hold up their end of the bargain,” the source said. “We have two cops that were injured. We’re being assaulted in the transit system while we’re doing our job.”
