KJ Biermann’s sexual assault, sodomy case has been ‘so traumatizing’ for jailed teen: lawyer

In a court hearing on Friday regarding KJ Biermann’s seven felony charges stemming from an alleged sexual assault involving a female classmate, the teen’s lawyer called the case “so traumatizing to [KJ] personally.”

Attorney Jason Sheffield pleaded with Judge Melynee Leftridge in Georgia’s Fulton County Superior Court on Friday to release the 15-year-old on $65,000 bond, saying of KJ, “He is not a boisterous kid. He is somewhat quiet.”

Sheffield told the judge that KJ’s mother, “Real Housewives of Atlanta” star Kim Zolciak, 48, would be able to monitor KJ, given that she’s currently not employed and staying at home.

Deputy District Attorney Caitlin McGillicuddy, citing “documented physical injury” in what she labeled the “predatory” sexual battery and sodomy case, asked that bond be set at $190,000.

While initially saying she would decide on KJ’s bond by Monday, Judge Leftridge ultimately set KJ’s bond at $200k later the same day — and issued several stipulations for his release, according to court docs obtained by Page Six.

He must stay at Zolciak’s home and attend school virtually, with no allowance for social media of any kind or cellphone use. Additionally, he cannot have direct or indirect contact with the victim or her family or associates as well as no contact with anyone aged 16 or under.

A victim statement read aloud in court asked the judge to “consider [her] safety” when deciding whether to release KJ on bond, noting that she has been “living in fear” over alleged threats the reality personality would come after her or her loved ones in the event of his release.

“No matter who these threats came from directly, I cannot just ignore them or assume that nothing will happen,” she wrote in the statement. “I am not only scared for myself anymore; I am scared for my family, too. Members of my family have received emails and phone calls because of this situation.”

“The thought of him being released scares me more than I can put into words,” the statement went on.

In court on Friday, as Page Six exclusively reported, McGillicuddy revealed that videos were discovered by investigators on KJ’s cellphone allegedly depicting the him having penetrative sex with a family member under the age of 12.

KJ — who faces seven felony charges from a separate alleged sexual assault involving a female calssmate in April — allegedly used “predatory, derogatory” language in the videos, McGillicuddy said of the “multiple encounters” allegedly found on the device.

“This would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind which involves female victims,” McGillicuddy said on Friday, noting that the reality personality was charged with sexual battery of a victim under the age of 16 over the alleged incident — which, until now, had not been reported.

McGillicuddy said KJ — whose father is Zociak’s estranged husband, Kroy Biermann — had been placed under court supervision due to the alleged incident, which took place in April 2023, in October 2025.

Sheffield defended the teen against the newly revealed allegation, saying “characterizations made in court regarding the prior juvenile matter … grossly misrepresent both the facts and the ultimate resolution of that case.”

“The matter arose from inappropriate, crude behavior involving two middle-schoolers. It did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense,” he continued. “Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved.”

Sheffield previously told Page Six of the charges stemming from KJ’s arrest last month on separate felony aggravated sodomy and felony aggravated sexual battery, “The fact that he’s been arrested and is being held without bond is a tragedy.”

He strenuously denied wrongdoing in the case, adding that KJ “is not only presumed innocent, but is, in fact, innocent.”

KJ was accompanied in court by his parents and sister Brielle Biermann, 29 — who is said to still be planning to wed Billy Seidl this fall — who supported KJ in the gallery at Friday’s hearing.

Zolciak appeared “stone-faced,” during the proceedings, and Kroy appeared “stressed” as he arrived on his own, sitting a row ahead of Zolciak and Brielle.

Sheffield petitioned for KJ’s release in a filing last week, writing that KJ “is a high school student in good standing who has demonstrated strong academic achievement and regularly participates in extracurricular and community-based activities.”

The filing added, “He is an accomplished football player who has received scholarship offers based upon his athletic ability.”

Sheffield previously filed a motion to keep his client’s case confidential and to transfer it to a juvenile court, after a hearing scheduled for Tuesday was suddenly canceled.

The attorney noted in the motion that KJ “is an adolescent whose development is ongoing.” Sheffield also wrote that the charges “carry a mandatory minimum sentence of 25 years in prison” without the possibility of parole.

He told Page Six that KJ is “expecting to enter not guilty pleas to all charges” at an arraignment scheduled for Oct. 14.

“I’m asking the public not to presume the truth of these allegations and to give the families on both sides their space and privacy,” Sheffield previously told Page Six.

On Sept. 3, following his shocking Aug. 17 arrest, the son of the former NFL star and “Real Housewives” personality was indicted by a grand jury on Sept. 3 on seven felony charges.

The charges include aggravated sexual battery, aggravated sodomy, false imprisonment, aggravated child molestation and three counts of aggravated sexual battery against a child under 16.

The charges stem from an alleged April 23 incident involving a minor classmate who described herself in documents as the “best friend” of KJ’s girlfriend.

The classmate alleged that KJ sexually assaulted her in a family at Life Time Fitness Center in Alpharetta, Georgia.

Court docs stated that she alleged KJ attempted “multiple times to have sexual intercourse with her by trying to pull down her pants,” despite her telling him “no.”

The classmate accused the TV star of forcing her to perform oral sex and subsequently digitally penetrating her vagina.

She claimed when she “finally managed to get away from him … he pulled up his pants and left.”

The classmate was examined at a medical center the following day, where no evidence of male DNA was detected in her vagina or mouth.

KJ was ultimately jailed at the Metro Regional Youth Detention Center following his arrest last month.

Zolciak has vigorously defended her son, labeling the accusations “reckless and deeply troubling”in a statement to Page Six, claiming her son had passed a polygraph test.

“He categorically denies ever being involved with this woman or engaging in the conduct she has alleged,” she continued, in part.

Zolciak and her estranged husband — who adopted Zoliak’s daughters from a previous relationship, Brielle and Ariana Biermann — are in the midst of a volatile divorce.

The former couple also share son Kash Biermann, 14, and twins Kane and Kaia Biermann, 12.
