Tate Brothers Must Remain in U.S. Jail Until Extradition Case Is Decided

A federal magistrate judge in Miami ruled on Wednesday that Andrew and Tristan Tate posed a flight risk and will remain behind bars as they fight extradition to Britain to face charges of rape and sex trafficking.

The decision, while expected, was another blow for the Tates, right-wing influencers known for their embrace of misogyny and hypermasculinity. The brothers, dual citizens of Britain and the United States, became wealthy by peddling online pornography and self-help courses on fitness, money and dating.

The magistrate was not swayed by the Tates, who took the stand during a detention hearing last month. They insisted that they needed to be released from near-solitary confinement at a Miami federal detention center to assist their lawyers in contesting the allegations against them, which they have repeatedly denied.

In a 30-page order published Wednesday, Magistrate Judge Lauren Louis wrote that even if the wealth that they have flaunted online was exaggerated, “they possess an exceptional capacity to flee the jurisdiction.”

She also wrote that they have no ties to Miami and that most of their family is overseas in Dubai and Romania, adding to their flight risk.

In recent years, the Tates have encountered widening legal scrutiny in Romania and Britain, where prosecutors have asked the United States to extradite them on new allegations involving four victims. Federal marshals arrested the brothers on July 18 outside a bare-knuckle boxing event in downtown Miami.

The Miami court has not set a date for an extradition hearing. The British government has until Sept. 16 to provide documentation to its U.S. counterparts on the allegations against the Tates.

The brothers have faced legal problems since their arrest in Romania in 2022 on allegations of human trafficking, among other serious crimes.

Earlier this month, Romanian prosecutors announced a second indictment against the brothers in the investigation they began in late 2024.

They accused Andrew Tate of recruiting a 15-year-old girl in 2012, housing her in Britain and Romania, and exploiting her for financial gain through pornographic webcam material. They accuse Tristan Tate of being complicit in sex trafficking and say that the brothers made more than $1.2 million from exploiting the girl. Andrew Tate is also accused of having sex with another 15-year-old.

In 2024, British authorities charged the brothers with rape, assault and human trafficking. A Romanian court agreed to extradite them to Britain, but only after the resolution of the cases against them in Romania.

In all, the Tates face allegations involving seven victims in Britain, prosecutors have said. In a court filing, the government described in graphic detail allegations that the brothers would choke women, sometimes until they passed out, before raping them.

Their lawyers in South Florida have described the Tates’ prosecution as political, decried their detention conditions as inhumane and argued to the court that the brothers’ “extraordinary notoriety and recognizability” would make sneaking out of the United States nearly impossible.

In 2025, Romanian prosecutors granted them permission to travel abroad after they had previously argued that the brothers were a public danger and a flight risk. Support from Trump administration officials played a crucial role, according to a New York Times investigation.
