President Donald Trump has said a “radical left” court cannot be allowed to terminate his tariffs and risk trillions of dollars of investment, dashing hopes for a return of U.S. “greatness.”

However, the court stopped short of striking the tariffs immediately, giving the administration time to appeal to the Supreme Court. The ruling will not take effect until October 14 and Trump has already signaled an appeal to the highest court in a Truth Social post after the ruling, saying in part, “ALL TARIFFS ARE STILL IN EFFECT!”
In his latest post on Truth Social on Sunday, the president reiterated the extent of the dangers that he said the court decision brought and called for urgent action to save his tariffs.

The U.S. Court of Appeals for the Federal Circuit, in a 7-4 decision, said on Friday that Trump’s reliance on the 1977 International Emergency Economic Powers Act to declare national emergencies and levy import taxes on nearly every U.S. trading partner exceeded his authority.
Trump said the court ruling imperiled the country.
“More than 15 Trillion Dollars will be invested in the USA, a RECORD. Much of this investment is because of Tariffs,” Trump wrote.
“If a Radical Left Court is allowed to terminate these Tariffs, almost all of this investment, and much more, will be immediately canceled! In many ways, we would become a Third World Nation, with no hope of GREATNESS again. TIME IS OF THE ESSENCE!!!”
The levies are central to Trump’s trade strategy. He has used them to pressure the European Union, Japan and others into what he touts as favorable trade deals, while boasting that tariffs have funneled huge revenues into the U.S. Treasury to offset the sweeping tax cuts he signed into law on July 4.
While Friday’s court decision complicates Trump’s ambition to fully upend decades of U.S. trade policy, he has other legal tools at his disposal, such as provisions in the 1974 Trade Act. But those authorities are narrower and limit how quickly and to what extent a president can act.
Customs duties collected under Trump’s tariff policies have surged in 2025, generating historic revenue for the U.S. Treasury.
Secretary of the Treasury Scott Bessent has said customs duty revenues could exceed $500 billion annually and approach $1 trillion as collections continue to climb.
But the tariff policy has been rolled out with little predictability, rattling global markets, straining ties with U.S. allies and trading partners, and fueling concerns of higher consumer prices and slower economic growth.
