Bill would ban vaping in most public places across Alabama

BIRMINGHAM, Ala. (WIAT) — A new bill recently filed in the Alabama Senate aims to remove vaping from the public square.

The bill, SB9, was filed by Sen. Gerald Allen back in June and would prohibit “the smoking of electronic nicotine delivery systems in the same manner as the smoking of tobacco products is prohibited.”

Currently, the Alabama Clean Indoor Air Act bans smoking tobacco products, such as cigarettes, in most public places and at public meetings. Under SB9, the act would be renamed the Vivian Davis Figures Clean Indoor Air Act, named after Alabama Sen. Vivian Figures.

The bill specifically outlines the public places that vaping would not be allowed, such as bars, lounges, child care facilities, the Alabama Department of Public Health, any business or company, government buildings, theaters or a service line.

With the decrease in cigarette use, vaping has become a popular device for nicotine delivery. Earlier this summer, the state enacted a law that adds regulations to businesses that sell vaping products, as well as restricting access to minors.

In different cities, such as Montgomery, local leaders have proposed having smoking ordinances, but those have been specifically related to tobacco products.

The Alabama Legislature will reconvene for the 2026 session Jan. 13.
