PHOENIX — The U.S. Court of International Trade blocked President Donald Trump from imposing sweeping tariffs on all imported goods under an emergency-powers law on Wednesday.
The lawsuit that the court ruled on was filed by Arizona Attorney General Kris Mayes and 11 other state attorneys general in April.
“This is a huge win for the state of Arizona, for frankly consumers, businesses and especially small businesses all over our state and all over this country,” Mayes told KTAR News 92.3 FM’s Outspoken with Bruce and Gaydos on Wednesday.
Mayes added that what she calls “the Trump tax increases” were on the verge of doing damage to the country’s economy and that some of that damage was already being seen in Arizona.
The attorney general called the court’s move “pretty extraordinary” since they were only seeking a preliminary injunction.
What happens now that the trade court has halted the tariffs?
The Trump Administration was given 10 days to unwind the tariffs.
Whether or not the court will issue a stay on the tariffs and they will remain in place is unknown.
“I don’t know if a court that just went ahead and ruled on the case is going to issue a stay. We’ll see,” Mayes said.
The attorney general added that it is “uncharted territory” if no stay is issued but the Trump Administration refuses to unwind the tariffs.
“On a couple of occasions the Democratic Attorney’s General have already had to go in and seek what is called a motion to compel against the Trump Administration for violating a federal court order. They violated the federal funding freeze order that we achieved and so we had to go back in and a federal court had to go back and order them to comply with it,” Mayes said.
“I hope that doesn’t happen here, but … there’s a little bit of a track record here with Trump and not abiding by federal court orders.”
Mayes did state that the Trump Administration will try to appeal the ruling to the U.S. Court of Appeals for the Federal Circuit and that she believes it will “almost certainly” end up at the Supreme Court.
