DECATUR, Ala. (WHNT) — The Morgan County District Attorney’s Office filed a notice this month saying they intend to seek the death penalty against a Decatur man going on trial for capital murder.
In March, a Morgan County Circuit Judge set a trial date for Kendall Rashaid Rucker. The trial is set for April 30.
According to an indictment filed in 2019, Rucker is facing seven capital murder charges for the shooting deaths of David Gullatte, 31, and Sharonda Bouldin, 27, as he “knowingly and unlawfully entered or remained” in their home.
The prosecution said in the notice that they intend to seek the death penalty because Rucker “caused the death of two or more persons by one act” and “the capital offense was committed by the defendant while engaged in the commission of, or attempt to commit, a robbery or burglary.”
On Feb. 28, 2018, the Decatur Police Department said a concerned citizen called 911 about shots being fired on Clearview Street. Officers confirmed that two people were killed in the shooting. Family members and officials confirm the victims are Gullatte and Bouldin.
Authorities said Rucker, 22 at the time of the shooting, had been identified running from the home moments after the gunshots. He was arrested at a separate home and charged with capital murder following the shooting.
The court found Rucker competent to stand trial in March following a court-ordered mental examination and a hearing.
