Lefty California Rep. Eric Swalwell isn’t qualified to run for governor of the Golden State — because he doesn’t officially live there, according to a bombshell new court claim.

Right-wing pundit and filmmaker Joel Gilbert said in a court complaint filed in Sacramento that Swalwell, considered the likely successor to Democrat Gov. Gavin Newsom, actually lives in Washington, DC, and is prohibited from running for the top state office under California law.

“Public records searches reveal no current ownership or leasehold interest held by Eric Swalwell in California, nor any history of any ownership of leasehold interest based on available public records,” said the petition filed by Gilbert on Jan. 8.

“Swalwell’s congressional financial disclosers from 2011 to 2024 list no California real estate ownership.”

Gilbert said in the filing that the California address Swalwell claimed in a campaign filing Dec. 4 is actually the office of the congressman’s lawyer and not a residence.

According to Article V, section II, of the California constitution, “The governor shall be an elector who has been a citizen of the United States and a resident of this state for 5 years immediately preceding the governor’s election,” the filing said.

Gilbert said that because of his findings, he wants Swalwell, a vocal critic of President Trump, to be knocked off the ballot.

“Either he’s guilty of mortgage fraud in Washington, DC, or he’s ineligible to run for governor of California,” the conservative activist told the Daily Mail. “He can’t have it both ways.”

Reps for Swalwell did not immediately respond to Post requests for comment.

The married father of three was born in Iowa but raised in California.

He was elected to the city council in Dublin, Calif., in 2010 and joined congress in 2013, where he continues to serve, according to his House of Representatives profile.

He threw his hat into the governor’s race last year.

Newsom was elected governor in 2018 and re-elected four years later but is barred from running again under the state’s term-limits law. He is now reportedly considering a presidential run.

Long-serving members of the US House and Senate typically maintain homes in the nation’s capital as well as addresses in their home states, with the lines blurred in some cases.
