It is unclear why the driver accelerated, but according to the outlet, the horrific scene was witnessed in front of multiple people including Silverman’s father.

The boy’s family has now filed a wrongful death lawsuitfor “severe negligence and systemic failures in supervision and campus safety,” alleging the school only implemented the proper safety improvements after their sons death, according to the outlet.

“We’ve done quite extensive investigation into how something like this could have happened, this unthinkable tragedy,” said Robert Glassman, the family’s attorney according to NBC4. “And unfortunately, what we’ve discovered is that the design of this parking lot was in fact very dangerous and was not compliant with California standards and regulations.”
