President Donald Trump took aim at the Supreme Court on Saturday. He reached back to his failed 2020 election challenge after a federal judge rejected his administration’s bid to set aside more than 20,000 California ballots.
In a Truth Social post, Trump praised Bill Essayli, the top federal prosecutor in Los Angeles. Trump called him “one of the best, EVER!” and claimed Essayli had “caught a massive number of Illegal Votes, 20,000, but potentially Hundreds of Thousands, and maybe even Millions.”
“The Court has just ruled against it,” Trump wrote. “Why would they reject fixing Election Fraud?”
He then compared the ruling to the Supreme Court’s refusal to take up a challenge to the 2020 election results.
“That’s like, in the 2020 Rigged and Stolen Election, when we had a great case, but the Supreme Court would not hear it because they said I, the President of the United States of America, had NO STANDING to bring such a case,” Trump wrote. “Think of it, the President, on a Federal Election, has NO STANDING over himself, and so it goes.”
That’s not quite what happened. In December 2020, the Supreme Court rejected a lawsuit brought by Texas, not Trump, against four battleground states, ruling that Texas lacked standing. Trump had asked to join the case. There is no evidence of widespread fraud in the 2020 election, which Trump lost to President Joe Biden.
The ruling that triggered Trump was from U.S. District Judge David O. Carter, who refused the Justice Department’s demand that California set aside more than 20,000 ballots from voters the government suspected might not be citizens. Carter wrote that he could not conclude the government’s process for building its list was “credible,” and noted that the DOJ “has prevailed in precisely zero” of 26 decided voter-roll lawsuits.
Trump also complained that Essayli has had to serve under “various other titles” because of the Senate’s “ridiculous Blue Slip SCAM,” the tradition that lets home-state senators block U.S. attorney nominees. A federal judge previously ruled that Essayli was unlawfully serving as acting U.S. attorney.
“We are going to continue our yearslong fight on Election Integrity,” Trump wrote.
