A lawyer for one of the accused men in the case brought by a woman who said she was gang-raped at a fraternity house at Cornell University in 2024 wants the judge to impose a gag order, limiting what parties and their attorneys can say outside of court.
The request comes after the court decided Friday to seal several documents in the case after complaints that a U.S. Marine and his family were harassed because he shares the same name as one of the defendants and his address was mistakenly included in the court files.
The lawsuit was brought by a former student, identified in court documents as Jane Doe. She is suing Cornell, the fraternity, seven men and others. No charges have been filed, though New York Gov. Kathy Hochul appointed a special prosecutor this month to look into the case.
James Knox, a lawyer for one of the accused men, told the court that the gag order was needed in part because Jane Doe’s lawyer has been making statements to the media that could prejudice “prospective jurors in any trial.”
“Plaintiff’s counsel has been trying his case in the media since filing the lawsuit,” Knox wrote.
Doe’s lawyer could not immediately be reached for comment on Monday.
