President Donald Trump’s effort to ban several major news organizations from the White House is “going to fail miserably,” legal expert Ryan Goodman predicted Tuesday.
Goodman, a CNN legal analyst and New York University law professor, told Erin Burnett that the administration’s national security argument faces several problems — beginning with when it emerged.
“It’s not the rationale that he gave on Friday,” Goodman said. “It’s the rationale he gave on Monday morning. That’s a problem for them.”
Goodman noted that Trump offered his now go-to explanation only after MS NOW made its legal complaint public, creating the appearance that the White House developed it in response to the network’s legal position.
“The courts look at that very unfavorably, because it’s a statement that’s made to influence the litigation, potentially,” he added.
Goodman also rejected Secretary of State Marco Rubio’s argument that the outlets remain free to operate and merely lost access to their White House workspace.
“It won’t hold up,” Goodman said Tuesday. “It’s in fact directly against what the D.C. Court of Appeals has said before.”
He told Burnett on her show, “Erin Burnett OutFront,” that excluding outlets because of their coverage would violate the First Amendment.
“It’s just going to fail miserably,” Goodman concluded.
