President Donald Trump already appears resigned to losing his latest battle against the press, CNN chief media analyst Brian Stelter said Tuesday.
CNN, MS NOW and Politico are asking a federal judge to overturn Trump’s unprecedented decision to bar them from the White House. The outlets argued in a lawsuit this week that Trump violated their First Amendment and due process rights when he issued the controversial new ban.
Asked whether he would allow the organizations back inside if the judge ruled against him, Trump replied, “Probably will, because he’s not a particularly fair judge, so you never know.”
Trump then defended the ban by citing national security.
“I think we have a right to clean out fake news,” he said. “You know, news is fake.”
Stelter described Trump’s response as a “realistic” assessment of his chances in court.
“This is a Trump-appointed judge who has been serving for years and who did side with CNN back in 2018 in the Jim Acosta case,” Stelter told viewers.
Stelter also questioned Trump’s attempt to tie the latest restrictions to national security, predicting that the court would “see right through” the argument.
“It seems the president might be resigned already to losing in this particular situation,” he concluded.
