KJ Biermann, 15, granted bond in sodomy and sexual battery case, will be released from jail

Kim Zolciak and Kroy Biermann’s 15-year-old son, Kroy “KJ” Biermann Jr., was granted bond on Friday as he faces seven felony charges in his sexual assault case.

Fulton County Superior Court Judge Melynee Leftridge ruled that the teenager be released from jail following Friday’s contentious bond hearing, where prosecutors revealed disturbing new allegations against KJ.

His bond was set at $200,000, according to court documents obtained by Page Six. Once released, he must stay at his mom’s home and attend school virtually. Additionally, he must abstain from social media and avoid cellphone use of any kind.

KJ is also barred from having any direct or indirect contact with the alleged victim, her family or associates, and cannot be in contact with anyone aged 16 or under.

The teen is subject to electronic monitoring once released.

KJ’s attorney, Jason Sheffield, had asked Leftridge to release his client on $65,000 bond, arguing that his incarceration has been “so traumatizing” and telling the court that the “Real Housewives of Atlanta” alum, 48, would monitor her son at home.

Prosecutors opposed his release and requested a $190,000 bond, pointing to the seriousness of the allegations and telling the court that the alleged victim suffered “documented physical injury” in the April incident.

The alleged victim also pleaded with the judge to consider her safety before releasing KJ, saying in a statement read aloud in court that she had been “living in fear” and that the thought of his release “scares me more than I can put into words.”

During Friday’s hearing, Deputy District Attorney Caitlin McGillicuddy also alleged investigators previously discovered multiple videos on KJ’s phone depicting him having sex with a female family member under the age of 12.

McGillicuddy claimed the videos showed “multiple encounters” and accused KJ of using “predatory, derogatory” language toward the alleged victim. She further told the court that KJ had been under court supervision since October 2025 in connection with that separate matter.

Sheffield pushed back on the newly revealed allegations, telling Page Six in a statement Friday that the “characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case.”

“The matter arose from inappropriate, crude behavior involving two middle-schoolers. It did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense,” he said.

Sheffield concluded, “Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved.”

Sheffield has maintained KJ’s innocence in the separate case currently before the court and said his client expects to plead not guilty to all charges.

KJ was indicted on Sept. 3 on seven felony counts — aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of aggravated sexual battery against a child under 16 and false imprisonment.

The charges stem from an alleged April 23 encounter with a female classmate at a Life Time fitness center in Alpharetta, Georgia.

The classmate accused KJ, who was 14 at the time, of forcing himself on her despite her repeatedly rejecting his advances. A medical examination conducted the following day found no male DNA in her mouth or vagina, according to a police report.

KJ has been held at Atlanta’s Metro Regional Youth Detention Center since his August arrest.

His legal team has separately asked for the case to be transferred to juvenile court, arguing that KJ’s development is still ongoing and pointing to the severe penalties attached to the adult charges.

He is scheduled to be arraigned on Oct. 14 and is expected to plead not guilty.
