There has been a major update after an Australian tourist was caught allegedly having sex in publicwhile on holiday in Bali.
Billy Aspinall was captured on CCTV allegedly engaging in a sex act with a woman he had just met on a resident’s driveway in North Kuta on Aug. 22.
The 27-year-old Sunshine Coast man was then arrested at Bali’s I Gusti Ngurah Rai International Airport after trying to board a flight home on Aug. 25.
Aspinall then spent the next two weeks in immigration detention.
Now, it has been revealed that Aspinall has been deported from Bali and has been banned from entering Indonesia for the next ten years.
The tourist was bound for Brisbane on a Batik Air flight on Tuesday night, according to national publication, the Bali Times.
The head of the Ngurah Rai Immigration Office, Muhamad Novyandri, confirmed the deportation on Wednesday.
He said the deportation represented the cooperation between immigration authorities and the local police in maintaining public order and supervising foreign nationals in Bali.
“The deportation of BA was carried out on Tuesday night using a Batik Air flight on the Denpasar-Brisbane route,” Novyandri said.
“We will continue to strengthen immigration supervision and maintain close co-ordination with law enforcement authorities, while taking firm action if violations of immigration regulations are found in the future.”
Novyandri added that the action was in line with the Immigration Directorate General’s ‘Immigration for the People’ approach, which emphasizes professional, humane and firm enforcement, the outlet reported.
The strict 10 year entry ban means that Aspinall will not be permitted to return to Indonesia in any capacity during the period of the sanction.
North Kuta chief police commander Ketut Sukadana said at the time that the alleged “indecent acts have the potential to cause public concern”.
“Particularly among the residents of Tibubeneng, and may negatively affect the image of security and tourism in the North Kuta area if the matter is not addressed and handled seriously by taking firm action against the perpetrators, whether under local customary law or national law,” he said.
The CCTV footage of Aspinall and the unidentified woman went viral late last month.
They were shown on camera allegedly performing several sex acts next to a residential property in Tibubeneng village, North Kuta.
The woman in the video has not yet been identified by authorities, although she is believed to be a foreign citizen who was drinking with Aspinall prior to the act.
A stunned local woman stumbled across the pair in the middle of the alleged sexual act as she was on her way to prayer.
She reportedly shouted at them to stop what they were doing, but they appeared to ignore her.
The entire alleged act lasted 15 minutes before the pair walked away.
Balinese locals held a cleansing ceremony at the site to purify it of bad energy.
Public acts of indecency and sex outside marriage are illegal in Indonesia, and foreigners caught can face jail time.
While Bali itself is predominantly Hindu, Indonesia is a Muslim-majority country that has conservative laws and harsh views on sex and pornography.
On Jan. 2, Indonesia formally implemented its new Criminal Code – a lengthy legal document which ushered in a number of new and revised laws that criminalize premarital sex, cohabitation and public drunkenness.
According to the new laws, adultery, premarital sex and cohabitation, or unmarried couples living together, are now potential crimes with penalties ranging from six months to a year in jail.
However, legal experts told news.com.au that unmarried couples traveling to Indonesia need not worry, as these crimes can only be reported to authorities by certain people.
“These alleged crimes cannot be processed by the police without a complaint which can only be filed by the legal husband or wife, parents or children of the perpetrator,” legal expert and founder of the People’s Law Center, Retno Murni, explained.
“Therefore, foreign tourists cannot be arrested, raided, or prosecuted simply for staying or residing with a partner, unless there is a valid complaint from these parties.”
However, Murni implored that as along as tourists “behave appropriately, respect local norms, and use official documents” they have nothing to worry about while visiting Indonesia.
