Rep. Max Miller (R-OH) is facing yet another serious allegation on top of an existing avalanche of scandals.

Miller swore under oath he had video proof his girlfriend witnessed a disputed custody exchange with his ex-wife. But according to Mother Jones, new court filings suggest that evidence quietly fell apart — and his own attorneys allegedly never corrected the record with the judge who granted him protection based on it.

Miller sought an emergency civil protection order against ex-wife Emily Moreno in February, telling Cuyahoga County Magistrate Jessica Bartolozzi that Moreno was lying when she accused him of shoving her during a custody handoff.

“I filed today because my ex-wife is making allegations against me,” Miller told the magistrate.

Under detailed questioning from his own attorney, Miller testified his girlfriend had been present during the exchange, watching from a window, and that Ring doorbell footage from his home confirmed she was there

But weeks later, one of Miller’s lawyers, Pamela MacAdams, emailed Moreno’s legal team admitting the doorbell footage actually showed the girlfriend “was in fact not likely present” during the exchange after all.

Moreno’s attorneys argue that email wasn’t enough. Under Ohio’s professional conduct rules requiring “candor toward the tribunal,” lawyers who learn evidence they presented was false must alert the court itself — not just opposing counsel. Moreno’s August 6 motion says Miller’s team never informed Magistrate Bartolozzi, even though the resulting protection order against Moreno stayed in effect for five months before Miller voluntarily dropped it in late July.

The congressman has faced widespread, bipartisan condemnation amid allegations he engaged in a horrific pattern of abuse against his family, including scalding Moreno with hot water and possibly causing their daughter’s broken collarbone.

Moreno has denied all allegations, and defied calls from his own party to resign or even withdraw from the ballot for another term before the deadline — partly, per reports, because President Donald Trump intervened on his behalf.
