‘Nervous’: Top MAGA lawyer melts down expecting 7-2 loss in birthright citizenship case

A top MAGA lawyer melted down on Wednesday after the Supreme Court heard oral arguments in Trump v. Barbara, a case that could determine whether birthright citizenship under the 14th Amendment is constitutional.

MAGA lawyer Mike Davis, who leads the Article III project, joined Steve Bannon on his “War Room” podcast to discuss the oral arguments, which President Donald Trumpattended. Both Bannon and Davis said Trump’s solicitor general, John Sauer, did a “phenomenal job” arguing Trump’s case before the court.

Davis expressed reservations about the likely outcome.

“If the Supreme Court follows the clear law here, it should be an easy case,” Davis said. “It should be 6-3, saying that birthright citizenship does not apply to illegal aliens. If the court follows the politics, it could be a 7-2 decision for birthright citizenship for 1.5 million Chinese birth tourists. I am a little bit nervous it will be the latter.”

Davis noted that Congress had to pass a statute granting citizenship to American Indians after the 14th Amendment was ratified. He wondered how the same logic would not apply to illegal aliens.

“You have to ask this further question: Do you think we fought a civil war to give citizenship to 1.5 million Chinese birth tourists?” Davis added.
