President Donald Trump’s immigration agents appear to think their power to arrest and detain Americans is limitless, according to a new report.
The Associated Press reported on a memo from Immigration and Customs Enforcement that it received, and described the document as a “sharp reversal of longstanding guidance meant to respect constitutional limits on government searches.” It was leaked at a time when tensions between ICE and the public are running high following the killing of Renee Good in Minneapolis, Minnesota, and a bevy of other intense confrontations between immigration agents and American citizens.
“The memo authorizes ICE officers to use force to enter a residence based solely on a more narrow administrative warrant to arrest someone with a final order of removal, a move that advocates say collides with Fourth Amendment protections and upends years of advice given to immigrant communities,” The AP reported.
The AP also reported that the memo’s contents have not been widely shared within the department but have been used to train new ICE recruits. New hires are being told to follow the guidance of the memo instead of other Department of Homeland Security training materials that contradict the memo, according to the report.
