Lawyers representing New York Attorney General Letitia James have accused President Donald Trump’s controversial Eastern District of Virginia prosecutor of covering up large amounts of evidence that needs to be turned over in discovery, Talking Points Memo reported on Wednesday.
Lindsey Halligan, who was appointed as a federal prosecutor after her predecessor balked at filing charges against Trump’s political critics, has brought a case of bank fraud against James, based on a thin accusation from Trump’s housing finance director that she claimed multiple properties as primary residences on mortgage statements. James has denied any wrongdoing, some outside legal experts have said that public evidence contradicts the allegations, and even a memo by prosecutors cast doubt on the case.
“In a new filing Monday, James lawyers asked the judge in the case to order the Justice Department to produce the documents reportedly turned over to prosecutors by former FHFA acting Inspector General Joe Allen,” said the report. “More intriguingly, James’ attorneys say the discovery they’ve already received from the government contains a gap … that suggests ‘over 100 pages of discovery likely turned over by the former FHFA Acting Inspector General has not been produced.’”
This comes after reports that Allen and a number of other ethics officials at the housing finance agency were fired around the time they started looking into whether administrator Bill Pulte, who leveled the accusations against James, improperly obtained mortgage data on Trump’s political adversaries.
At the time of their firing, the administration claimed it was because they were promoting diversity, equity, and inclusion (DEI) policies that ran contrary to Trump’s policies.
Halligan, who also brought charges against former FBI Director James Comey, is separately facing accusations she was improperly appointed as U.S. attorney and isn’t even authorized to be bringing prosecutions in the first place.
