‘Cuckoo stuff’: Trump’s bid to free convict ally bashed by legal expert

President Donald Trump appears to be on a warpath to free one of his convicted allies, but the arguments the administration has put forward in court read like the rantings of a madman, according to one legal expert.

Trump has been trying to free Tina Peters, a former Colorado county clerk who was convicted of seven state crimes related to her granting Trump allies unauthorized access to her county’s voting machines, for more than a month. Peters is currently serving a nine-year sentence for her crimes.

In early December, Trump issued a “pardon” for Peters on his Truth Social platform. His administration has also appealed to Colorado state leaders to release Peters, a request that was rebuffed.

Peter Ticktin, a lawyer representing Peters, has appealed her case to the Supreme Court, citing George Washington’s pardon of people who participated in the Whiskey Rebellion.

Michael Popok, a lawyer and host of the “Legal AF” podcast, reacted to Ticktin’s appeal in a new video on Wednesday.

Popok noted that Presidential pardons only apply to federal crimes, not state crimes. He also picked apart Ticktin’s argument, which he at times described as sounding as if it were lifted from the History Channel. Ticktin rants about his denial of the 2020 election, and when he began to “run out of steam,” as Popok said, he argued that Peters had “performed her federal duty to preserve election records.”

“No. She turned them over to MAGA in order to make some cockamamie argument that Donald Trump’s election was stolen from him, in a year, by the way, in which he won the election,” Popok shot back.

“Cuckoo stuff,” Popok said.
